Thank you for choosing to commission or purchase an artwork from Endear Portraiture and Rachel Wolfe. These Terms & Policies outline the conditions under which I create, sell, and deliver original artworks. By placing a commission, purchasing artwork, or using this website, you agree to the following terms and policies:
In this Terms of Service:
“Artist”, “I”, “me”: refers to Rachel Wolfe, operating as Endear Portraiture and Rachel Wolfe Fine Arts.
“Artwork” “Portrait” “Painting”: refers to the original artwork created by the Artist, including paintings, drawings, mixed-media works, or portraits.
“Client”, “you”: refers to the individual purchasing artwork or commissioning a piece.
“Commission” refers to a custom artwork created specifically for a client based on reference images and information provided.
“Deposit” refers to the upfront non-refundable payment required to secure a commission.

B. TERMS OF SERVICE
Acceptance of Terms: By using the website or commissioning or purchasing an artwork, you agree to abide by these Terms in full.
Commission Process: The commission process includes consultation, submission of reference photos, proposal acceptance, payment of deposit, portrait creation, review and approval, final payment, and delivery. By commissioning an artwork, you agree to participate in each step and to provide necessary information and feedback in a timely manner.
Reference Images: The quality of the final artwork depends largely on the quality of the reference photos provided. You warrant that you have permission to supply any images and that doing so does not infringe on copyright. I reserve the right to refuse any reference photos that are deemed inappropriate, offensive, insufficient in quality, or violate copyright or privacy laws.
Ownership Transfer: Ownership of the artwork passes to you once full payment is received.
Intellectual Property Rights: I retain full copyright and moral rights in all artworks created, including but not limited to reproduction rights. You may not reproduce, edit, distribute, or sell any artwork or image of artwork without prior written permission. Purchasing an artwork does not transfer copyright. I may photograph and publish commissioned artwork for portfolio, website, promotional and educational purposes unless you request otherwise in writing at the time of commissioning.
In situ Photos: Any in situ photos provided are for illustrative purposes only, do not represent exact scale and colour and serve as examples of how the artwork may appear in a living space.
Framing: Artwork pricing does not include framing. A floating frame can be added for an additional cost, depending on size and materials. This includes professional assembly and mounting.
Customer Responsibilities: You agree to:
7.1. provide accurate and complete information;

7.3. review and approve the final artwork before it is delivered or shipped. Any errors or inaccuracies identified after approval are not the Artist’s responsibility.
C.Payment Policy
I aim to make the payment process simple, transparent, and convenient for my valued customers. Please review my payment policy outlined below:
Commission Deposit: Upon agreeing to proceed with an artwork commission, a non-refundable deposit is required to secure your booking in my schedule. The deposit amount is 50% of the total artwork cost and work does not begin until the deposit is received.
Payment Methods: Accepted methods include PayPal, bank transfer, or other agreed-upon methods. All payments must be made in the currency specified in the invoice or proposal.
Payment Schedule: The remaining balance is due upon final approval of the completed artwork sent by email. I will send you an invoice for the remaining balance, including any applicable shipping costs, taxes and incidentals, once you have provided final approval of the completed artwork. The artwork will not be shipped or released until full payment has been received and cleared.
Price Exclusions: The prices contained within the website exclude framing, postage, optional insurance and any additional changes or requests.
Additional Charges: Additional charges may apply for custom requests, changes to the original agreement, rush orders, additional subjects, and shipping fees. Any additional charges will be clearly communicated and agreed upon before proceeding with the commission.
Cancellation Policy: In the event that you need to cancel your commission after the deposit has been paid, the deposit is non-refundable.
D.Shipping & Insurance Policy
Packaging and Shipping: All artworks are packaged with care using protective, archival materials to ensure safe transport. Once your artwork is shipped, you will receive a tracking number so you can follow its journey to you.
Delivery Method: Artwork is shipped via Australia Post Parcel Post or Express Post, depending on your preference.
Insurance (Optional): Australia Post offers optional Extra Cover to insure the artwork for its full value while in transit. This is not included in the standard postage cost. If you would like to add insurance, please let me know before shipping so I can include it in your invoice. If insurance is declined, responsibility for any loss or damage during transit rests with the recipient.
3.1. Insurance cost: approximately $50-100, depending on the artwork’s declared value
3.2. Covers: loss or damage in transit
3.3. Recommended for original artworks and commissions
Transfer of Risk: Risk transfers to you once the parcel is lodged with Australia Post or a courier.
Transit & Delivery Time: Standard delivery times typically range from 2–8 business days within Australia, depending on location. Express Post is available upon request. Delays caused by postal services are outside of my control.
Local Pickup: If you are based in Hobart, pickup or hand delivery can be arranged at no additional cost.
E.Returns Policy
I strive to ensure that every artwork commission meets or exceeds your expectations. However, I understand that there may be circumstances where a return or refund is necessary. Please review the returns policy below:
Satisfaction Guarantee: I stand behind the quality of my work and aim to provide you with an artwork that you will cherish for years to come. If, for any reason, you are not satisfied with the final artwork, please contact me within 7 days of receiving your artwork to discuss your concerns.
Eligibility for Returns: Returns are accepted for artworks that have:
2.1. significant defects;
2.2. inaccuracies compared to the provided reference photos; or
2.3. the artwork has not already been approved prior to shipping.
Returns are not accepted for artworks that represent the reference photos provided at the time of commissioning, and the final artwork has been reviewed and approved by you before it is delivered or shipped.
Return Process: To initiate a return, please contact me via email or phone to discuss the reason for your dissatisfaction and provide supporting evidence, such as clear photographs highlighting the issue. Once your return request is approved, I will provide you with instructions on how to return the artwork safely and securely.
Refund or Exchange: Upon receiving the returned artwork and verifying the issue, I will offer you the option of a refund or an exchange. If you choose a refund, the original payment method used for the purchase will be credited within 7-10 business days. If you prefer an exchange, I will work with you to create a new artwork that addresses the identified concerns.
Return Shipping Costs: You are responsible for covering the cost of return shipping unless the return is due to my error or a significant defect in the artwork. You must use a trackable shipping service and purchase shipping insurance to ensure the safe return of the portrait.
Non-Returnable Items: Customised artworks that represent the subject based on the provided reference photos, and the final artwork has been reviewed and approved by you before it has been delivered or shipped are non-returnable. Gift certificates and digital products are non-returnable and non-refundable.
F. Privacy Policy
I am committed to protecting your privacy and ensuring the security of your personal information. This privacy policy outlines how I collect, use, and safeguard the information you provide to me.
Information I Collect: When you commission an artwork, I may collect personal information such as your name, email address, mailing address, and phone number. I may also collect reference photos for the purpose of creating the artwork.
Use of Information: I use the information collected to communicate with you about your portrait commission, including sending updates on the progress of your portrait and notifying you of any changes or issues, and shipping the artwork. Your contact information may also be used to send promotional materials or special offers related to my services, but you have the option to opt out of receiving such communications.
Data Security: I take reasonable measures to protect the personal information you provide to me from unauthorised access, disclosure, alteration, or destruction.
Party Disclosure: I do not sell, trade, or otherwise transfer your personal information to third parties without your consent, except as required by law or to fulfill the purpose of your commission.
Website and Social Media Photos: By commissioning an artwork, you consent to images of your completed artwork being used for promotional purposes on the website and social media, unless you notify me in writing at the time of commissioning.
Cookies: The website may use cookies to enhance your browsing experience. You have the option to disable cookies in your browser settings, but please note that some features of the website may not function properly as a result.
G. ENDEAR PORTRAITURE GIFT VOUCHERS
Validity: Gift vouchers are valid for three (3) years from the date of purchase. The expiration date will be clearly stated on the voucher.
Redemption: Endear Portraiture Gift Vouchers can be redeemed only for pet portrait commissions by Endear Portraiture. To redeem, the recipient must contact Rachel Wolfe to schedule the commission and provide the voucher code.
Non-Refundable: Gift vouchers are non-refundable. No refunds or exchanges will be provided for unused vouchers.
Non-Transferable: Gift vouchers are non-transferable and cannot be exchanged for cash. They are intended for the recipient only and cannot be used by others.
Partial Use: If the full value of the voucher is not used in one transaction, the remaining balance can be applied to future commissions within the validity period.
Booking: Commission slots are subject to availability. Recipients are encouraged to book their artwork slots early to secure a spot.
Customisation: Gift vouchers can be used towards custom pet portrait commissions only. Additional charges may apply for specific custom requests or upgrades.
H.GENERAL
Agreement: By commissioning an artwork, you acknowledge that you have read and agree to the Terms & Policies.
Limitation of Liability: I am not liable for :
2.1. any indirect, incidental, special, or consequential damages, losses or expenses arising out of or in any way connected with the use of my services or work; or
2.2. any delays outside of my control; or
2.3. any loss or damage to the artwork during transit where insurance was declined.
Governing Law: These terms of service shall be governed by and construed in accordance with the laws of Tasmania without regard to its conflict of law provisions.
Australian Consumer Law: Nothing in these Terms limited your rights under Australian Consumer Law.
Modification of Terms: I reserve the right to update or modify all or any part of the Terms & Policies at any time without prior notice. It is your responsibility to review periodically.
